Waiver and Release of Liability

By signing up for and/or attending classes, events, activities, and other programs and using the premises, facilities and equipment (individually and/or collectively, the “Classes and Facilities”) of RIDE ON FITNESS, LLC, a Florida limited liability company (“Studio”), the undersigned and their heirs, personal representatives and/or assigns (hereinafter referred to as “I,” “me,” or “my”), that there are certain inherent risks and dangers in indoor cycling and exercise equipment in association with the Classes and Facilities.

I acknowledge that some of the risks cannot be eliminated regardless of the care taken to avoid injuries. I also acknowledge that the specific risks vary from one activity to another, but include minor injuries, scratches, bruises, sprains, eye injuries, joint injuries, back injuries, heart attacks, concussions, catastrophic injuries, paralysis, death, seizures, rhabdomyolysis, among others. I understand that the Classes and Facilities may contain flashing lights and other luminous stimulations which may induce epileptic seizures in certain individuals.

In  consideration of allowed participation in and access to the Classes and Facilities, I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that the Studio and its insurers, employees, officers, directors, and associates, shall not be liable for any damages arising from personal injuries (including death) sustained by me, on, or about the premises, or as a result of the participation in and use of the Classes and Facilities, regardless of whether such injuries result, in whole or in part, from the negligence of the Studio.

By the execution of this Waiver, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me, and I hereby fully and forever release and discharge the Studio, its insurers, employees, officers, directors, and associates, from any and all responsibility, claims, demands, damages, rights of action, or causes of action, present or future, to the fullest extent allowed by law whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the participation in and use of the Classes and Facilities.

I expressly agree to indemnify and hold the Studio harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me. I acknowledge and confirm that the release and indemnity contained herein shall extend to and include claims that may arise out of, or are caused or alleged to have been caused by, the negligence or gross negligence of Studio, their agents, employees, or representatives.

I agree to comply with all rules imposed by the company regarding the Classes and Facilities. I agree to conduct myself in a controlled and reasonable manner at all times, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose.

I understand and agree that the Studio is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises.

I do not have a medical or physical condition that would prevent me from using any of Studio’s Classes and Facilities. I do not have a physical or mental condition that would put me in any physical or medical danger, nor have I been instructed by a physician or other healthcare professional not to participate in physical exercise.

BY AGREEING, I IRREVOCABLY CONFIRM THAT I (1) HAVE READ THE FOREGOING WAIVER AND RELEASE OF LIABILITY, (2) VOLUNTARILY, EXPRESSLY, AND KNOWLINGLY CONSENT TO ASSUME THE RISK OF THE DANGEROUS CONDITIONS, RISKS, AND HAZARDS EXPRESSED HEREIN, AND (3) HAVE VOLUNTARILY EXECUTED THIS WAIVER WITH FULL KNOWLEDGE OF ITS CONTENT.
